MediaCreator.ai Terms of Service

• What we sell: subscription plans and prepaid AI credit packs. Both are digital and are delivered to your account immediately after payment — see section 4.
• Subscriptions: Paid plans are automatic-renewal subscriptions — you authorise recurring charges to your payment method at the start of each billing period until you cancel. You can cancel at any time from your account settings or by emailing support@mediacreator.ai. Renewal, billing cycles, free trial conversion, plan and price changes, cancellation, and failed payments are governed in full by our Subscription Terms, which form part of these Terms.
• Currency: all prices and charges are in US dollars (USD). Plan limits and prices are listed on the Pricing page.
• Refunds: Purchases of subscriptions and AI credit packs are final and non-refundable, except in the cases set out in our Refund Policy — duplicate charges, billing errors, undelivered purchases, unauthorised transactions, or where applicable law requires a refund.

Free trials require a valid payment method and convert automatically into a paid subscription when the trial ends unless you cancel first. The trial length, how conversion is billed, and how to cancel before being charged are set out in our Subscription Terms.

• Delivery is made to the MediaCreator.ai account you were signed in to at checkout — there is no separate delivery address to provide.
• A subscription is delivered by activating the plan on that account. A credit pack is delivered by adding the credits to that account's balance.
• You access what you bought by signing in at crm.mediacreator.ai. A payment receipt is emailed to the address on your account.

• Order processing time: immediate — normally within 1 minute of the payment being confirmed by our payment provider, and within 1 hour at the latest. Processing is automatic; there is no manual handling step and no working-day dependency.
• Estimated delivery time: immediate — the plan or credits are usable as soon as processing completes, 24 hours a day, 7 days a week, including weekends and public holidays.
• If a payment confirmation is delayed: on the rare occasion that our payment provider's confirmation is delayed, an automatic reconciliation runs every 10 minutes and completes the activation. Your order will show as pending until it does.

• First, sign out and sign back in, and check that you are signed in to the same account you used at checkout — a purchase is delivered to that account only.
• If a charge has succeeded but the plan or credits are still not active after 1 hour, email support@mediacreator.ai with the date and amount of the charge. We reply within 1 business day and either complete the delivery or refund the charge in full — see section 4 of our Refund Policy.

• The service is delivered worldwide over the internet, wherever the social platforms we integrate with are available.
• You need an internet connection and a current web browser. To publish, you also need to connect at least one social account over OAuth 2.0.

• Your Content: You retain ownership of content uploaded/created via the Service ("User Content").
• License to Us: By using the Service, you grant MediaCreator a worldwide, royalty-free license to:
  • Store, process, and display User Content to operate the Service.
  • Use aggregated/anonymized data to improve our AI models.
• AI-Generated Content: Outputs created by MediaCreator’s AI are your property, subject to these Terms.
• Prohibited Content: You may not upload content that:
  • Violates laws or third-party rights (e.g., copyrights).
  • Is abusive, deceptive, or promotes illegal acts.

• Provide accurate account information. You are responsible for all activity under your account.
• Notify us immediately of unauthorized access.

• MediaCreator.ai owns all platform code, AI models, designs, and trademarks. You may not:
  • Reverse-engineer, scrape, or misuse the Service.
  • Use our trademarks without written permission.
• User Content remains your property.

• The Service integrates with social platforms (e.g., Instagram, TikTok). You comply with their terms.
• We are not liable for third-party services.

• We may suspend/terminate your access for breaches, non-payment, or illegal activity.
• You may cancel subscriptions anytime via account settings.

• Service "AS IS": We do not guarantee error-free operation. You use the Service at your own risk.
• No Indirect Damages: We are not liable for:
  • Lost profits, data, or business opportunities.
  • User Content or third-party actions.
• Maximum Liability: Limited to fees paid in the 6 months preceding a claim.

• Your breach of these Terms.
• User Content or misuse of the Service.

• Governing Law: These Terms and any separate agreement whereby we provide you Services are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (Laws of Hong Kong).
• Dispute Resolution:
  • Informal negotiation (30 days) required before legal action.
  • Individual arbitration (not class actions) administered by the Hong Kong International Arbitration Centre (HKIAC) under its rules, seated in Hong Kong.

• Apple bears no warranty obligations.
• Claims must be directed to MediaCreator (not Apple).
• You comply with Apple’s Media Services Terms.
